In the case of Buffington v. Progressive Insurance, the Plaintiff filed a Class Action Complaint against The Progressive Corporation and Progressive Advanced Insurance Co., properly identified herein and in subsequent filings as Progressive Advanced Insurance Company (“Progressive Advanced”) in the Southern District of New York asserting claims for breach of contract, violation of New York’s General Business Law (“NYGBL”) § 349, and unjust enrichment (ECF No. 1). The Parties engaged in extensive litigation, including completion of fact and expert discovery, and had a full and fair opportunity to evaluate the strengths and weaknesses of their respective positions. After extensive review of the underlying facts, arms-length negotiations between Class Counsel and Progressive’s counsel, and multiple mediations, Normand PLLC was able to obtain a settlement in the amount of $250,000.
